1. Acceptance of Terms

Welcome to PEYWENDI. By creating an account or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service.

You must be at least 18 years old to use PEYWENDI. By using our service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on our service. Your continued use of PEYWENDI after such modifications constitutes your acceptance of the updated Terms.

2. Account Eligibility

To create an account on PEYWENDI, you must meet the following requirements:

• Age: You must be 18 years or older
• One Account: You may only maintain one account. Creating multiple accounts is prohibited
• Authentic Information: You must provide accurate, truthful information about yourself
• Real Photos: All profile photos must be of you and accurately represent your current appearance
• Single Status: You must be legally single and genuinely seeking relationships
• Human User: Accounts must be operated by a real person, not bots or automated systems

We reserve the right to verify your eligibility at any time, including requesting additional verification such as photo ID or video verification.

3. Acceptable Use Policy

You agree NOT to use PEYWENDI to:

3.1 Harassment & Abuse

• Harass, bully, threaten, or intimidate other users
• Send unwanted sexual content or propositions
• Use hate speech or discriminate based on race, religion, gender, sexual orientation, or disability
• Stalk or repeatedly contact users who have blocked you

3.2 Fake Profiles & Impersonation

• Create fake profiles or use someone else's photos
• Impersonate another person, celebrity, or entity
• Misrepresent your identity, age, location, or relationship status

3.3 Commercial Activity

• Solicit money, gifts, or donations from other users
• Promote or advertise products, services, or websites
• Use PEYWENDI for commercial gain or business purposes
• Recruit users for multi-level marketing or pyramid schemes

3.4 Spam & Abuse

• Send spam, unsolicited messages, or bulk communications
• Use automated systems, bots, or scripts to interact with the service
• Farm achievements, credits, or rewards through exploits

3.5 Privacy Violations

• Share other users' private information without consent
• Screenshot or record private conversations without permission
• Share or distribute other users' photos or voice recordings

3.6 Inappropriate Content

• Upload nude, sexually explicit, or pornographic content
• Share violent, graphic, or disturbing content
• Post illegal content or content that promotes illegal activities

4. Content Ownership & License

4.1 Your Content

You retain ownership of all content you upload to PEYWENDI, including photos, voice recordings, messages, and profile information ("Your Content"). By uploading Your Content, you represent and warrant that:

• You own all rights to Your Content or have obtained all necessary permissions
• Your Content does not violate any third-party rights (copyright, trademark, privacy, etc.)
• Your Content does not violate any laws or regulations

4.2 License to PEYWENDI

By uploading Your Content, you grant PEYWENDI a non-exclusive, worldwide, royalty-free license to use, store, display, and process Your Content for the purpose of:

• Operating and providing our service to you and other users
• Showing your profile to potential matches
• Generating AI-powered insights and compatibility scores
• Improving our algorithms and features
• Complying with legal obligations

This license terminates when you delete Your Content or your account, except where we are required to retain it for legal compliance.

4.3 Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms. We use automated systems and human reviewers to detect inappropriate content. Content that is flagged may be:

• Automatically rejected (e.g., explicit content)
• Queued for manual review
• Removed without notice if it violates our policies

5. Prohibited Conduct

In addition to the Acceptable Use Policy, you agree NOT to:

• Create multiple accounts to circumvent restrictions or bans
• Use bots, scrapers, or automated tools to interact with the service
• Harvest, collect, or store other users' personal information
• Reverse engineer, decompile, or disassemble any part of our service
• Circumvent security measures, rate limits, or access controls
• Interfere with or disrupt the service, servers, or networks
• Introduce viruses, malware, or other malicious code
• Access or attempt to access accounts that do not belong to you

6. Subscriptions & Payments

6.1 Subscription Tiers

PEYWENDI offers free and paid subscription tiers with different features. Subscription details, pricing, and features are displayed on our pricing page and may be updated from time to time.

6.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged using your saved payment method. Prices may change with notice, but the new price will only apply after your current subscription period ends.

6.3 Cancellation

You can cancel your subscription at any time from your account settings. Upon cancellation:

• Your subscription will remain active until the end of your current billing period
• You will not be charged for subsequent billing periods
• Your account will revert to the free tier after the paid period ends
• No refunds will be provided for partial months

6.4 Refund Policy

No Refunds: All subscription fees and credit purchases are non-refundable, except where required by law. We do not provide refunds for:

• Partial subscription periods
• Unused credits or features
• Account terminations due to Terms violations
• Dissatisfaction with matches or results

6.5 Credits

Credits are virtual currency used to unlock premium features (Super Likes, Boosts, etc.). Credits:

• Are purchased with real money and are non-refundable
• Have no cash value and cannot be redeemed for money
• Do not expire while your account is active
• Are forfeited upon account deletion
• Cannot be transferred to other users

7. Termination

7.1 Termination by You

You may delete your account at any time from your account settings. Upon deletion:

• Your account enters a 30-day grace period during which you can cancel the deletion
• Your profile is immediately hidden from other users
• Your messages are anonymized
• Your photos and voice recordings are deleted
• After 30 days, your account is permanently deleted
• Any active subscriptions are automatically cancelled
• No refunds are provided for remaining subscription time or unused credits

7.2 Termination by PEYWENDI

We reserve the right to suspend or terminate your account at any time, without notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your account is used for fraudulent or illegal activities
• You are reported by multiple users for harassment or abuse
• Your content violates our content policies repeatedly
• You create multiple accounts after being banned
• We are required to do so by law or court order

Upon termination for violations, no refunds will be provided and you forfeit all remaining credits and subscription benefits.

7.3 Effect of Termination

Upon account termination (by you or us):

• Your license to use PEYWENDI immediately terminates
• We may delete or retain your data as described in our Privacy Policy
• We retain transaction records for legal and accounting purposes
• These Terms survive termination where applicable (e.g., liability limitations, dispute resolution)

8. Disclaimers & Limitation of Liability

8.1 Service "As Is"

PEYWENDI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Results

We do not guarantee that you will find matches, dates, or relationships through our service. The success of your experience depends on many factors outside our control, including your profile, activity, location, and the users in your area.

8.3 User Conduct

PEYWENDI is not responsible for the conduct of any user, whether online or offline. You are solely responsible for your interactions with other users. We recommend:

• Meeting in public places for first dates
• Informing friends or family of your plans
• Not sharing financial information
• Reporting suspicious or abusive behavior

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEYWENDI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the service
• Damages resulting from user conduct or content
• Unauthorized access to or alteration of your content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PEYWENDI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Dispute Resolution

9.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@peywendi.app to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

9.2 Arbitration (US Users)

For users in the United States, any dispute arising from these Terms or the service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, rather than in court. You and PEYWENDI waive the right to a jury trial.

9.3 Class Action Waiver

YOU AND PEYWENDI AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

9.4 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any arbitration or legal proceeding shall take place in Wilmington, Delaware.

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PEYWENDI and supersede all prior agreements, understandings, and communications.

10.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

10.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
